One man is dead and another is in custody after Clear Creek Sheriff’s deputies responded an Empire-area burglary, and the incident turned into a shootout early Sunday morning.

The deputies involved were uninjured.

According to Undersheriff Bruce Snelling, the Sheriff’s Office received a 911 call around 5 a.m. Sunday reporting a burglary-in-progress in the 1000 block of Morrison Lane, which is off U.S. Highway 40 west of Empire.

The resident, who was not home at the time, reported seeing the suspects on his property through security cameras.

Sheriff’s deputies arrived at Morrison Lane about 30 minutes later and found two adult men and two vehicles that appeared to be stuck on the road.

As deputies approached, the suspects pulled out firearms and reportedly began shooting at the deputies. They fired back, killing one. The other fled into the woods, and was found and arrested by Clear Creek and Jeffco SWAT and a Jeffco K-9 unit around 9:35 a.m.

Snelling has confirmed that the Colorado Bureau of Investigations will be assessing the incident, and the deputies involved will be placed on leave pending the investigation’s outcome.
